Will of Jacob Cole



Please contact me if you have Whatleys, Dukes, Dumases, Colliers, Gardners, Suttons as well as Coles. These families were friends AND relatives of my Cole family. The Whatleys, Dukes and Dumases appear on various legal documents relating to my families. Also, if you have a Winniford that you believe married a Cole, we are looking for the maiden name of one Winneford/Winnie who married Jacob Cole between 1789 and 1792. She may have been a Duke, a Dumas, or a Whatley. Winnie would have been born abt. 1770.

The following documents were transcribed from copies of the originals by Ernest Mae Seaholm and Paula Anne Baker, descendants of Jacob Cole, November 2001.


Pike County, Georgia Will Book C, page 32

Georgia, Pike County
In the name of God amen.
I Jacob Cole being advanced in years but of sound and perfect mind and 
memory blessed be the Almighty God for the same do make and publish this to 
be my last will and Testament.
1st I give and bequeath unto my beloved wife Winnford Cole during her 
natural life the lot of land where I now live namely lot No. 126, number one 
hundred and twenty-six and half of lot No. 98 it being the south half of 
said lot all the land lying in the seventh Dist of formerly Monroe now Pike 
County also my negro man Simon together with all my stock consisting of 
Horses hogs cows and the household and kitchen furniture farming utensils 
and after my wifes decease, I give and bequeath unto my beloved daughter 
Nancy Collier the south half of the lot of land No 98 number ninty eight in 
the Seventh Dist of formerly Monroe now Pike County and I also give her the 
___or horse that may belong to the estate at my wife's death .
3rd I give and bequeath unto my beloved grandchildren the heirs of my 
beloved Son Henry Cole the lot of land No 126 number one and twenty six in 
the Seventh Dist of formerly Monroe now Pike County to be theirs and each of 
  theirs equally with the reserve that their Father Henry Cole shall have 
the use of so much of the land as he can cultivate during his natural life 
and it is further my will that after my wifes death that my negro man Simon 
and all the perishable property belonging to the estate shall be sold and 
equally divided amongst my children namely Nancy Collier, Henry Cole and 
William Cole.
I(n) testimony whereof I the said Jacob Cole have hereunto set my name and 
affixed my seal this the Twenty ninth day of September in the year of our 
Lord one thousand Eight hundred and forty.
Assigned in the presence of Vachal D. Whatley and John E. Duke J.P.

I Jacob Cole have it in my will and request that my son William Cole should 
be Executor and Execute this my will and Testament September 29th 1840

On 4th September 1848 William Cole swore that the will was Jacob Cole's last 
will and Testament.

I John E. Duke do hereby swear that I saw Jacob Cole sign seal publish and 
declare this writing to be and contain his will and at the time thereof he 
was of sound disposing mind and memory and that he did it freely without 
_________to the best of my knowledge and that I saw Vachal Whatley sign the 
same as witness.  ________in vacation this 3d July 1848.

I William Cole do solemnly swear that this writing contains the true, last 
will and Testament of Jacob Cole deceased so far as I know or believe and 
that I will and well truly execute the same by paying first the debts  and 
then the _______contained in the said will so far as his goods and chattel 
will ________ if tried and the law charges me and that I will make a true 
and perfect inventory of all such goods and chattels so help me God this 4th 
September 1848.
